NSW POLICE OFFENCES ACT 1901 - SECT 70 

Beating carpets, flying kites, breaking horses etc. in street or public
place

70. Whosoever in any street or public place beats or dusts any carpet,
or flies any kite, or drives any vehicle for the purpose of breaking,
exercising, or trying any horse, or rides any horse for the purpose of
exercising, trying, showing, or exposing such horse for sale (otherwise
than by passing through such streets or public places while so driving
or riding) shall be liable to a penalty not exceeding four dollars.

Specifically removing the non-kite junk...

  Whosoever in any street or public place, ...  flies any kite, ...
(otherwise than by passing through... ) ... shall be liable to a penalty
not exceeding four dollars.

Four Dollar Fine every time you fly a kite in NSW, now that is sad for
the Festival of Winds coming up :-)
